The cabin is located near the north Lake Tahoe and Highway 267 intersection for easy access to NorthStar Ski Resort and casinos/restaurants/nightlife. It has a double bed in one bedroom, a single bed and bunk bed in another bedroom, and a futon couch in the living room that converts into a bed for 2.  Two bedrooms upstairs;  living room dining area, kitchen, and bathroom are downstairs.  The cabin rental rate may vary according to the season. SKI LEASE RENTAL AGREEMENT
Golf-Course Cabin

I/We, as Tenant, agree to lease the house at 7867 Mashie Avenue, Tahoe Vista, California 96143, from the Owners (Stanley M. Sokolow and Sonya Sokolow, Trustees) and managed by Sokolow Property Management, under the following terms which are mutually agreed by Owners and Tenant.

TERM OF LEASE:  I/We agree to rent for the period:

RENT PAYMENTS:  I will pay the first month's rent, the last month's rent, and a security deposit, all in advance. The security deposit shall normally be an amount equal to one month's rent.  (Owners may require additional security if Tenant applicant does not have adequate evidence of creditworthiness.)  In addition, I will pay a pet deposit if applicable (shown below), and a non-refundable cleaning fee.  The deposits will be refundable as provided by California law, less any costs for cleaning, repairs, or other expenses due to my fault.  I agree to vacate on time, but if I fail to do so for any reason without Owners' consent, I agree to pay a stay-over charge of $100 plus additional rent at the nightly rate for each day or fraction of a day that I stay over without permission of Owner's agent.  Stay-over with consent of Owners or Owners' agent shall be negotiable.  The rent for each month following the first month will be due on the same day of the month as the starting day of the lease, payable in advance of that date. (For example, if the lease starts on the 10th day of the month, the rent for each subsequent month will be due before the 10th day of each following month and will be considered late if payment has not been received by Owner or Owner's agent before that date, or if payment is mailed and not postmarked by that date.)  LATE RENT PAYMENTS WILL BE CHARGED AN ADDITIONAL  5%, WHICH SHALL BE DUE IF PAYMENT IS NOT MADE TIMELY.  THE LATE PAYMENT CHARGE SHOULD BE ADDED TO THE RENT AND PAID WHEN THE LATE RENT IS PAID.  THERE IS NO GRACE PERIOD.  FAILURE TO PAY MAY RESULT IN TENANT BEING GIVEN A 3-DAY NOTICE TO PAY OR VACATE, AS PROVIDED BY CALIFORNIA LAW.

OPTIONAL ELECTRONIC PAYMENT:  Property manager can receive your payment online from your credit card,  through PayPal. To pay online, fill in the information requested on this form, print out the form, sign it, and fax it to Sokolow Property Management. On the form write “Please send PayPal instructions” if you wish to pay by credit card through PayPal, the online payment service of the eBay Company. The requested instructions will be sent by email.

When your payment and agreement are received, property manager will send an e-mail message confirming the reservation and giving you instructions on obtaining the key.

CANCELLATION:  I understand that I may cancel this reservation at any time up to 30 days before the starting date and receive a full refund less a $100 cancellation fee. I agree that if I cancel with less than 30 days' notice before the starting date but at least 14 days' notice in advance, I will forfeit half of the rent deposit and receive a refund for the rest of my prepaid amounts. If I cancel less than 14 days in advance, there will be no rent refund except of the unused cleaning fee and the security deposit.

CLEANING, DAMAGE, SECURITY REFUNDS:  I agree to leave the house in as good condition as when I receive it. I will pay for any damages I cause. I will leave the place reasonably clean, but I understand that a professional cleaner will also clean the place after I move out even if I leave the place reasonably clean.   This is a no-smoking house, so smoking inside the house is not an authorized use.  Cleaning to remove smoking odors will therefore be charged to Tenants.   Even if Owners authorize Tenant to bring a pet, the cleaning of premises to remove pet debris (such as pet hairs or urine odors) will be at Tenant's expense. The unused security deposit will be refunded as soon as possible, but within 21 days after end of rental, as provided by California law, unless delayed by the time required to repair damage.

UTILITIES:  The rent includes garbage removal, water and sewer service, routine spa service (when available), cable TV, local telephone service, and snow plow service when needed in winter. I will take reasonable care to conserve these utilities. I will put my garbage in bags into the garbage can in the locker in front of the house, making sure the door is latched to prevent animals from getting into it. I will take all of my food and garbage out of the house when I vacate. I won't park so close to the locker that the garbage disposal workers can't remove the garbage cans. I will promptly move my car out of the way of the snow removal tractor when it arrives. (The snow will be stockpiled along the sides and rear of property.)  The outdoor spa will be kept operating throughout the year, but without a guarantee; that is, if a spa malfunction or severe weather condition prevents use of the spa, no refund or rent reduction will be made.  The telephone has a restricted service which blocks outgoing toll and long-distance calls, but allows local outgoing calls and all incoming calls.  (Cell phone signal is spotty or non-existant in the neighborhood of this house.)

The following utility charges will be billed to the Tenant by Owner for the usage that exceeds the baseline monthly allowance for this service: Electricity, gas, extra telephone call charges if any are billed to the house phone, and any extra charges for additional garbage in excess of one container per pick-up. These utility charges will be due when billed to Tenant and will be late if not paid or postmarked within 10 days.  Baseline allowances during this lease are: $100 per month for gas, $100 per month for electricity, the regular monthly charge for telephone, and the regular monthly charge for garbage.

MAIL, INTERNET, NOTICES:   The U.S. Postal Service does not deliver to any houses in the Tahoe area.  Instead, it is necessary to go to the post office to receive mail.  Tenant should contact the local post office (Kings Beach) for information on how mail should be addressed to Tenant and how to pick up mail.  If  Tenant establishes a post-office box, Tenant should notify Owners or Owners' agent.  Notices and billing invoices will be sent to Tenant from Owners by email over the Internet, and a copy sent to Tenant by U.S. mail addressed to the principal tenant by "general delivery" to the Kings Beach post office or to the Tenant's  post-office box number if so notified.   The local phone service can be used for connection to the Internet through a modem and Tenant's own computer to the Tenant's own Internet Service Provider (ISP).  In many ISP databases, the city is called "Kings Beach" or "Brockway" or "Old Brockway", California. 

WATER SHUT-OFF:   Advice to Tenant:  When you first arrive, you may find that the water in the house has been shut off.  This is normal during the winter season.  There is a shut-off water valve at the floor inside the cabinet of the dining area, nearest to the downstairs bathroom door.  Turn the handle a quarter turn (90 degrees) to open the valve so water can flow normally.  After turning it ON the first time, listen for water running in sinks downstairs and upstairs, since the previous occupant may have left a faucet open after the water was shut off.  When you move out of the house, be sure to follow the instructions below about "winterizing" the house, especially about turning the water valve OFF again.

WINTERIZING, BLOCKAGES:  I will follow the instructions posted inside the house regarding winterizing the house, especially about the water shutoff and drain when my stay is finished, and about the proper setting of the heating thermostat when I'm out of the house.   That is, when the Tenant vacates the house at the end of the lease, the water shutoff lever on the floor of the cabinet nearest to the downstairs bathroom should be turned to the position which shuts off the water supply to the faucets in the house and the upstairs bathroom sink faucet should be opened for one minute to let air into the pipes and then closed fully again.  The downstairs shutoff valve should be left in the OFF position when you finally leave.   When you finally leave, the thermostat of the heating system should be left ON, but the temperature setting turned down to the lowest number, to prevent freezing of the pipes.  I understand that severe damage can occur to the plumbing system if I fail to do the winterizing in freezing weather, and that I would be financially responsible for the repair charges. Sewer blockages caused by improper things being put down drains during my stay will be cleared or repaired at my expense.

I will return all keys as instructed by Owner's agent when I vacate. I will in advance arrange with Owner if I intend to bring any pets onto the property and will be responsible for any damage that a pet causes. I'll clean up the property from any feces droppings or other mess that my pet makes. My guests and I won't annoy the neighbors by making a nuisance. I agree that violating any of my promises could end my stay in the house prematurely.

SAFETY, INSURANCE:  I agree for my own safety to test the smoke detectors when I move in, by pressing the test button momentarily. I'll replace the battery if a detector fails the test. I will locate the emergency escape ladder in the second story and become familiar with its use in case a fire escape is needed through a window. I won't smoke inside the house. I understand that the Owner's insurance does not cover my belongings, and I agree that Owner will not be held liable for any loss of my belongings for any reason whatsoever . I will promptly report any malfunctions of the house to Owner's agent. I agree that if the house is not available or habitable for any reason beyond the control of Owner or Owner's agent, my only remedy will be a refund.

SPA:  I will follow the posted instructions for spa use. Children will not use the spa without the direct continouous supervision of an adult.  No one will use the spa while intoxicated.  When not in use, the spa will be covered and the cover will be latched for child safety.  I will exercise care when lifting the spa cover -- the cover is supported by a mechanical lever system that should not be forced -- it will open easily if done properly.  In winter, be sure that snow is not blocking the lever system before lifting it.

TENANTS UNDERSTAND AND AGREE THAT THE USE OF THE SPA BY TENANTS AND THEIR GUESTS IS AT TENANTS' OWN RISK AND LIABILITY, AND AGREE TO HOLD THE OWNERS AND OWNERS' AGENT HARMLESS.

ADDITIONAL PROVISIONS:  The email messages sent between Tenant and Owners or Owners' agent contain additional important information about this house and this lease.  Those messages are hereby made a part of this lease agreement.  Tenant should bring a copy of this lease and of the Reservation Confirmation for reference at the house.
