LEASE AGREEMENT
I/We, as Tenant, agree to lease the
studio condominium unit at 7610 N. Lake Blvd, Unit #11 (in Tahoya
Shores condominium), Tahoe Vista, California 96143, from the
Owners
(Stanley M. Sokolow, Sonya Sokolow, and Elisabeth V. Tatum), and Owners
agree to lease to Tenant, under the following terms which are
mutually agreed by Owners and Tenant. "Tenant" refers to
all renters identified in this lease, jointly and severally.
Here is the information
about all adults who will be tenants of the unit. (If there are more
than two, provide the additional information on another page.)
WHERE TO SEND PAYMENTS: This total should be submitted by cashier's check, money order, or equivalent official check (not a personal or business check) or by electronic funds transfer. Also print out, complete, and mail to the address below or fax this agreement to 831-423-4840. For questions about billing and payment, call 831-423-1417. To be sure that the payment and agreement arrive in time for your trip when there are just a few days before you want to arrive, we suggest overnight mail or electronic transfer if time is short. OPTIONAL ELECTRONIC PAYMENT: Property manager can receive your payment online from your credit card, through PayPal. To pay online, fill in the information requested on this form, print out the form, sign it, and fax it to Sokolow Property Management. On the form write “Please send PayPal instructions” if you wish to pay by credit card through PayPal, the online payment service of the eBay Company. The requested instructions will be sent by email.
When your payment and agreement are received,
property manager will send an e-mail message confirming the
reservation and giving you instructions on obtaining the
key. If Tenant does not have access to email, Tenant should
notify Owner's agent to send the confirmation through regular postal
service mail.
OWNERS' AGENT:
In addition to the local companies (such as utilities) and persons
(such as the house cleaner) mentioned in the Reservation Confirmation
email, Tenant should contact the following person (Owner's Agent)
regarding questions or
problems involving this property:
CANCELLATION: I understand that I may cancel this reservation at any time up to 90 days before the starting date of this lease and receive a full refund less a $200 cancellation fee. I agree that if I cancel with less than 90 days' notice before the starting date but at least 30 days' notice in advance of the starting date, I will forfeit half of the rent deposit and receive a refund for the rest of my prepaid amounts. If I cancel less than 30 days in advance of the starting date, there will be no refund except of the unused cleaning fee and the security deposit.
CLEANING, DAMAGE, SECURITY
REFUNDS: I
agree to leave the unit in as good condition as when I receive it. I
will pay for any damages I cause. I will leave the place reasonably
clean, but I understand that a professional cleaner will also clean
the place after I move out even if I leave the
place reasonably clean. This is a no-smoking unit, so smoking
inside the unit is not an authorized use. Extra cleaning to
remove
smoking odors will therefore be charged to Tenants who violate this
prohibition. The unused security
deposit will
be refunded as soon as possible, but within 21 days after end of
rental, as provided by California law, unless delayed by the time
required to repair damage or to obtain the estimated charge.
UTILITIES: The rent
includes garbage removal, water and sewer service, routine spa and pool
service (when available), cable
TV, local telephone service, water heating, electricity, and snow plow
service when needed in winter. I will take reasonable care to
conserve these utilities. I will put my garbage in bags into the
garbage bin in the front of the building. I will take all of
my food and garbage out of the unit when I vacate. I will promptly move
my car out of the way of the
snow removal tractor if requested. The outdoor spa will be
kept operating throughout the year in the discretion of the condominium
owners' association, but without a guarantee; that is,
if a spa/pool malfunction or severe weather condition prevents use of
the
spa or pool, no refund or rent reduction will be made. The
telephone has restricted service which blocks outgoing toll and
long-distance
calls, but allows local outgoing calls and all incoming calls.
(Cell phone signal may be weak inside this unit.)
TENANT CHARGES FOR EXCESS
UTILITIES: Electricity usage in excess of $__100.00__ per month will
be billed to the Tenant by
Owner and shall be considered additional rent due immediately on
receipt of notice. The electric bill will be adjusted to
reasonably reflect
the Tenant's monthly usage when occupancy does not exactly coincide
with the
electric billing cycle. These charges will be due when billed to
Tenant and will be late if not paid or postmarked within 10 days. Late
payment will be subject to the Late Payment Fee stated above.
Since mail is not delivered to the unit, Tenant should inform the
management or Owner's
Agent (Shannon Sokolow) about the Tenant's local mailing address
(general delivery, post-office box number, or whatever) and/or call
Owner's Agent to determine if there were any excess utility usage
charges.
EMERGENCIES INVOLVING THE PREMISES:
In the event of a serious emergency, such as plumbing leakage causing
flooding within the unit, Tenant should immediately call the on-site
resident manager Alma Herrera 530-546-5943 and/or Owner's real estate
agent Sue Daniels 530-210-0222.
MAIL, INTERNET,
NOTICES: The U.S. Postal Service does not deliver
to any homes in the Tahoe area. Instead, it is necessary to go
to the post office to receive mail. Tenant should contact the
local post office (Kings Beach) for information on how mail should be
addressed to Tenant and how to pick up mail at the office.
If Tenant rents a post-office box, Tenant should notify Owners or
Owners'
agent. Notices and billing invoices will be sent to Tenant from
Owners by email over the Internet, and a copy sent to Tenant by U.S.
mail addressed to the principal tenant by "general delivery" to the
Kings Beach post office or to the Tenant's post-office box number
if so notified. The local phone service can be used for
connection to the Internet through a modem and Tenant's own computer to
the Tenant's own Internet Service Provider (ISP). In many ISP
databases, the city is called "Kings Beach" or "Brockway" or "Old
Brockway", California.
WINTERIZING, BLOCKAGES: I
will follow the instructions regarding the proper setting of the
heating
thermostat when I'm out of the unit. That is, when I
finally leave, the
thermostat of the heating system will be left ON, but the
temperature setting turned down to the lowest number, to prevent
freezing of the pipes. I understand that severe damage
can occur to the plumbing system if I fail to do the winterizing in
freezing weather, and that I would be financially responsible for the
repair charges. Sewer blockages caused by improper things (such as
paper towels or tampons) being put
down drains during my stay will be cleared or repaired at my expense.
KEYS, NUISANCE, VIOLATIONS: I
will return all keys as instructed by Owner's agent when I
vacate. My guests and I won't annoy the
neighbors by making a nuisance. I agree that violating any of my
promises could result in fines described below and may end my stay in
the unit prematurely.
OWNERS' ASSOCIATION RULES,
REGULATIONS, AND FINES: This unit is subject to the
Association Rules and Regulations, and the Declaration of Covenants,
Conditions and Restrictions (CC&Rs) of the Tahoya Shores
Condominium Owners Association, Inc. (A copy of the
CC&Rs is available on the Internet at http://www.tahoyashores.com
under the "Our Association" menu item.) The main rules for
tenants and guests are included in this lease below, but Tenant is
obligated to comply with all of the Association's rules even if not
stated herein. Tenant agrees to follow the rules, including any
rules not shown here if and when Tenant is informed of the rule.
The Association is empowered to issue fines against Tenant or against
the Owner, and/or
suspend Tenant's privileges to use the common areas and common
facilities, for violation of the rules by Tenant or
by Tenant's guests or for other misconduct which disturbs the quiet
enjoyment of the residents within the condominium project.
The Governing Documents of the Association provide due process
requirements for disciplinary actions. If the Association
duly fines Tenant or Owner for Tenant's or Tenant's guest's failure to
comply with these provisions, the fines shall be considered additional
rents which
become immediately due and must be paid to Owner for payment of the
fine to the Association. Any fines not paid by Tenant
within 7 days of notice to Tenant shall be subject to the Late Payment
Fee stated above. Except as prohibited by law,
non-compliance with these provisions or non-payment of fines shall be a
breach of
this lease agreement and may result in termination of the lease and
removal of Tenant from premises by process of law. Unpaid
fines shall be considered to be unpaid rent.
VERTICAL BLINDS: This
unit has vertical blinds on windows and as a room divider. The controls
for the blinds allow the vertical vanes to be turned so they are "open"
or "closed" to see through or not, and also the vanes can be slid to
the side like a drape. It is
important that the blinds be in their "open" rotation when they are
being slid sideways, otherwise they become tangled and may be
damaged. If vanes get stuck and won't rotate or slide
easily, they can be unstuck by looking for vanes that are overlapping
improperly near the top of the vane at the track. Gently
manipulating the vanes will untangle them so they can move
properly. If strong force seems to be required, something
is tangled. Untangle it first, otherwise force will damage the
blinds.
PETS: I
declare that I will not bring any pets onto the
premises. Guide dogs, signal dogs, service dogs, and
equivalent service animals especially trained to assist a tenant with a
disability shall not be considered pets if they meet the provisions of
California Civil Code section 54.2.
SAFETY, INSURANCE: I
agree for my own safety to test the smoke detectors when I
move in, by pressing the test button momentarily. I'll replace the
battery if a detector fails the test. I won't smoke inside
the unit. I understand that the Owner's insurance does not cover my
belongings. I agree that Owner will not be held liable for any
loss of my belongings for any reason whatsoever . I will promptly
report any malfunctions of the unit to Owner's agent. I agree that
if the unit is not available or habitable for any reason, my only
remedy will be a refund.
DATABASE DISCLOSURE NOTICE: The California Department of Justice, sheriff's departments, police departments serving jurisdictions of 200,000 or more, and many other local law enforcement authorities maintain for public access a databse of the locations of persons required to register pursuant to paragraph (1) of subdivision (a) of Section 290.4 of the Penal Code. The database is updated on a quarterly basis and a source of information about the presence of these individuals in any neighborhood. The Department of Justice also maintains a Sex Offender Identification Line through which inquiries about individuals may be made. This is a "900" telephone service. Callers must have specific information about individuals they are checking. Information regarding neighborhoods is not available through the "900" telephone service. Additional information about sex offenders may be displayed on the Internet at http://www.meganslaw.ca.gov.
SPA AND POOL: I will
follow the
posted instructions for spa and swimming pool use. Children
will not use the spa or pool without the direct continouous supervision
of an
adult. No one will use the spa while intoxicated. When
not in use, the pool gate should be latched for
child safety.

ADDITIONAL PROVISIONS: The
email messages sent between Tenant and Owners or Owners' agent contain
additional important information about this unit and this lease.
Tenant should bring a copy of this lease and of the Reservation
Confirmation for reference at the unit.

Tahoya Shores Condominium Association
Rules and Regulations for Renters and Guests
Effective September 6, 2008
Tahoya Shores’ Board of Directors has adopted these Rules and Regulations for the benefit of every guest and owner. Violations of these rules subject the renter to monetary fines and other penalties including removal from the common areas and eviction from the unit.
1. Animals/Pets/Visitors
Pets
are not allowed in any rental units or on Tahoya Shores property by
renters or their
guests.
Guests or visitors must park off site. Guests/Visitors shall be
limited to a party of
four
(4) per unit. Parties larger than four shall be subject to monetary
fines and removal for
trespass.
